      Prof busted in Columbia gal 'punch'

      The New York times today, has a piece about a Columbia professor that punched a woman, a fellow employee, during an argument about race.

      The professor, who is black, had been engaged in a fiery discussion about "white privilege" with Davis, who is white, and another male regular, who is also white, Friday night at 10:30 when fists started flying, patrons said.

      The punch was so loud, the kitchen workers in the back heard it over all the noise," bar back Richie Velez, 28, told The Post. "I was on my way over when he punched Camille and she fell on top of me."

      The other patron involved in the dispute said McIntyre then took a swing at him after he yelled, "You don't hit a woman!"

      "He knocked the glasses right off my face," said the man, who would only give his first name as "Shannon." "The punch came out of nowhere. Mac was talking to us about white privilege and what I was doing about it -- apparently I wasn't doing enough."

      McIntyre had squabbled with Davis several weeks earlier over issues involving race, witnesses said. As soon as the professor threw the punch Friday, server Rob Dalton and another employee tossed him out.

      "It was a real sucker punch," Dalton said. "Camille's a great lady, always nice to everybody, and doesn't deserve anything like this."

      Davis was spotted wearing sunglasses yesterday to conceal the black eye. Reached at her Columbia office, she declined to comment on the alleged attack.

      McIntyre was released without bail at his arraignment last night.

      "It was a very unfortunate event," he said afterwards. "I didn't mean for it to explode the way it did."



      So, sounds to me as though someone has a chip on their shoulder about white people.

  • Obama’s Newest Racemongering J

      President Obama has gone out of his way to "diversify" the federal bench with his spate of nominations of various minorities chief of which was his successful seating of the "wise Latina,' Sonia Sotomayor, on the Supreme Court. Obama's nominees* for 10 district court openings include four African-Americans, three Asian-Americans, one Latino and four women. One of those nominees, San Francisco U.S. Magistrate Judge Edward Chen, received a favorable vote in the Senate Judiciary Committee in Washington today.

      So what sort of judge is Edward Chen? Well, for one, the left-wing American Bar Association rated Chen a "well qualified" nominee and many of his associates at the ACLU speak highly of him. As an ACLU lawyer, Chen was known for opposing English-only policies and for pushing discriminatory affirmative action ideals. He even came to the aid of gang members in one case. Chen was quite the ACLU activist between 1979 and 2001.

      His ACLU history would suffice to make many wary of him, of course. But for a segment of America, working for the ACLU is not a disqualifier. So in order to judge Edward Chen one must look at his past. Discovering what Judge Chen thinks of the country upon which he apparently assumes to sit in judgment is a telling exercise. Sadly, it seems he has quite a low opinion of the nation that he will be serving.

      One hint at Judge Chen's feelings about our nation can be seen from his appearance at the 2005 graduation ceremony at the Hastings Public Interest Law Foundation. There, Chen wondered aloud if American patriotism was justified. Chen told the crowd of his, "feelings of ambivalence and cynicism when confronted with appeals to patriotism -- sometimes I cannot help but feel that there are too much [sic] injustice and too many inequalities that prevent far too many Americans from enjoying the beauty extolled in that anthem." Apparently, Chen feels that America is too racist to justify anyone feeling patriotism for her.

      In fact, racism seems to be one of Chen's major concerns and he sees it everywhere. Immediately after the attacks on 9, 11, 2001 Chen's first thoughts were about racism but not that of the Arabs that sent over three thousand Americans to their deaths. No, as soon as Chen learned of the attacks of 9/11 Chen's first worry was that white Americans were going to use their racism to justify racist attacks on Muslims and anyone else that got in their way.

      Only ten days after 9/11 occurred, Chen remarked that he imagined that America would revert to the "irresistible forces of racism, nativism and scapegoating" of the past and begin systematic oppression of American Muslims. Later he likened America's post 9/11 military and security policies to the climate that led up to Japanese interment during WWII. In fact, he seemed to imagine that "a thousand Americans" were being swept up and held in secret prisons right after 9/11.

      In a speech given at the Operation Protect and Defend dinner on May 4, 2006, Judge Chen referred to "secret surveillance of Americans without a judicial warrant, secret no fly lists, [and] secret detention of nearly a thousand American residents held without charges." Naturally, he offered no proof of this wholesale but secret detention of Americans.

      Chen also saw racism in the aftermath of Hurricane Katrina in 2005, as well. Chen charged that the reason that New Orleans had so much trouble after the storms passed was because the inhabitants of the Crescent City were black. "Institutionalized racism" caused the federal government's supposedly slow response to the crisis there, Chen said. At the Diversity Celebration of the California State Bar Convention in 2005, Chen asked the audience, "Would the response have been different had the majority of victims been white and middle class rather than poor and black? Would the response have been quicker had it been Kennebunkport instead of New Orleans?"

      Racism again came to vex Chen's overactive imagination in the aftermath of the Virginia Tech shootings perpetrated by an Asian man. Chen's fevered imagination dreamed up images of Asian men being discriminated against all across the country because of the actions of one mentally unstable nut. In comments before the Asian Pacific Americans in Higher Education Conference, Chen worried that Asians would be the "subject of a racial backlash, victimized" by hate crime.

      It is apparent that Edward Chen does not find much to celebrate about the United States. The whole country is so filled with "injustice" and "inequalities" that only a crusading judge can right the wrongs.

      Now, what of his judicial standards? What sort of philosophy does Chen employ on the bench? Is it a strict standard of reading at law, or is he one of those sorts of judicial activists that uses the law to spread his own particular philosophy of social justice? Sadly, it appears to be the later. At least one can be excused to think this from a 2003 article Chen wrote entitled “The Judiciary, Diversity, and Justice For All” published in the California Law Review.

      "...diversity enhances the quality of decision-making. . . . judges have to make determinations that draw not so much upon legal acumen, but on an understanding of people and of human experiences. Such experiences inform assumptions that affect legal decisions. At trial and in evidentiary hearings, judges have to assess the credibility of witnesses. A witness’ testimony may seem more credible if it is consistent with the judge’s knowledge or experience, and, conversely, less credible if it remains outside the judge’s experience. . . . Simply put, a judge’s life experiences affect the willingness to credit testimony or understand the human impact of legal rules upon which the judge must decide. These determinations require a judge to draw upon something that is not found in the case reports that line the walls of our chambers. Rather judges draw upon the breadth and depth of their own life experience, upon the knowledge and understanding of people, and of human nature. And inevitably, one’s ethnic and racial background contributes to those life experiences."

      Of course, this attitude seems to register well with Obama's views of "judicial empathy." In this view the law is heavily influenced by the judge's "feelings" and those feelings are at least as important as the written law. This also matches well with Sotomayor's ideas that her status as a Latina made her more qualified than an old white man to be a judge. For Obama's judges, experiences and feelings trump the Constitution and the law and these experiences and feelings should be used as a basis to adjudicate the cases that come before them.

      In Chen's case we can see that the main influence on his judicial philosophy is an inordinate fear of racism. He sees it under his bed, in his closet, in the faces of everyone he meets. With this penchant in mind, can Chen honestly, dispassionately, and seriously serve effectively as a federal judge? One cannot help but wonder if his preoccupation with envisioning racism in every situation makes Judge Chen ill-suited for the federal bench where a dispassionate mien is required. It is easy to see that his constant resorting to charges of racism will likely color every decision he delivers.

      Judge Chen will bring "diversity" to the bench as President Obama wants certainly. But will he also bring divisiveness and a desire to get even with all the racism he sees where ever he looks? His record hints that he just might.

      Two African-American circuit nominees, highly regarded sitting district judges Andre Davis and Joseph Greenaway, earned well-qualified American Bar Association ratings, the organization's highest ranking. The third, well-respected Rhode Island Superior Court Associate Justice O. Rogeriee Thompson, was nominated last week and has yet to receive an ABA ranking. The four Asian-American nominees would increase by 36% the number of Asian-American judges. They include Southern District of New York Judge Denny Chin, who would be the first Asian-American judge on the U.S. Court of Appeals for the 2d Circuit; California Superior Court Judge Jacqueline Nguyen, who would be the first Vietnamese-American district judge; and Magistrate Judge Edward Chen, who would be the first Asian-American member of the Northern District of California. Both Nguyen and Chen earned well-qualified ABA ratings, while the ABA has not yet ranked Chin.

      Betty Williams is an Irishwoman who won the Nobel Peace Prize. She said, “I have a very hard time with this word ‘non-violence,’ because I don’t believe that I am non-violent. . . . Right now, I would love to kill George Bush.”

      Garrison Keillor, that lovable government-radio scamp, described the Republicans as follows:

      Portsmouth PD: Shea-Porter was removed from Bush town hall by two police officers

      Two officers of the Portsmouth, New Hampshire Police Department removed Carol Shea-Porter and Susan Mayer from a February 2005 town hall event hosted by then-President George W. Bush at the request of the owner of the property, a spokesman for the Police Department tells NowHampshire.com.

      The revelation contradicts statements made by Congresswoman Carol Shea-Porter as recently as this week that she was not removed from the event.

      “[T]here were no disruptions and no rudeness and I wasn’t removed. If it happened, don’t you think there would have been photos or video or news stories from that day? There aren’t because it didn’t happen,” Shea-Porter told the Portsmouth Herald this weekend.

      She has referred to participants in so-called taxpayer tea parties as “tea baggers” and refused to apologize when made aware of the sexual connotation of that phrase.

      Shea-Porter has made a series of incorrect and sometimes bizarre statements in recent weeks. She has stated, for example, “many of my constituents would love to wait in line for medical care.” And she justifies the House bill to overhaul America’s health care system by saying, “the Constitution did not cover everything.”

      Thats it... "the tools at our disposal", according to Nancy Pelosi are only "diplomacy to sanctions".

      Victor Davis Hanson : Obama’s Naïve Outreach
      I don’t think the so-called outreach to Russia — a state which has been much of the problem rather than any part of a solution with Iran — will help curb Iran’s nuclear ambition in the slightest. Iran will still try to cause trouble in Iraq and Afghanistan, and will acquire an atomic bomb soon unless it is stopped. And I don’t think Islamists inside the U.S. care a whit that Barack Obama is now president, except when noting their perception of a relaxation in our anti-terror efforts. And I especially don’t think China or Japan cares who is the American president, but will increasingly begin to call in geopolitical chits in exchange for financing our gargantuan and growing debt. In other words, some pretty tough actors are unimpressed by utopian hope and change, and are presently in the process of sizing us up to learn what are the new rules, if any.

      And if our outreach — talking to Chávez while snubbing Uribe and the Hondurans, a muffled response to the extradition of the Lockerbie terrorist to Libya, and talking with/sending videos to the Iranian regime — is supposed to pay dividends, I can’t imagine what they might be. Based on the recent unhinged performances at the U.N., I think it is easy to conclude that the anti-Americanism of Ahmadinejad, Chávez, and Qaddafi is some sort of brain disorder.
      The Real World
      Although Obama referred to the nuclear ambitions of both Iran and North Korea during the session, diplomatic maneuvering kept any mention of the two countries out of a resolution that the council unanimously approved. The omission prompted passionate criticism from French President Nicolas Sarkozy, who will join Obama and British Prime Minister Gordon Brown Friday morning to decry Iran's newly disclosed facility.

      "How, before the eyes of the world, could we justify meeting without tackling them?" Sarkozy scolded Thursday, referring to Iran and North Korea. "We live in the real world, not a virtual world. And the real world expects us to take decisions."

      Sure... now that Iran has two secret plants surrounded by Russian supplied anti-aircraft batteries, instead of power transmission lines, to enrich uranium when Iran is only allowed to buy uranium from Russia we need to draw a line in the sand... now?

      Brown said Friday that the international community has no choice but to draw a line in the sand by demanding that Iran abide by United Nations resolutions and open the facility to inspections.
      Gordon Brown is on his way out... he's less popular in the UK then Bush is in the (D)emocrat party.

      Per NBC’s Andrea Mitchell, officials say it was U.S. intelligence that learned of the secret plant more than a year ago — before President Obama's election; Israel also knew about it, too. They most likely would not have gone public if Iran had not discovered that the U.S. was onto them and had it not notified the U.N.'s international inspection agency on Monday. By the way, Mitchell adds, the site is 30 kilometers outside of Qum, Iran’s holy city. That means that any military strike would be very difficult politically, because it would around huge reaction throughout the Muslim world. Also today, watch for Russian and Chinese reaction. Yes, they were notified of our intelligence this week, but their reaction is unknown.
      Yes... Qum will shield the Mullah's efforts... just as Barack Hussein Obama did and will continue to do so.

      Remember the central rationale of Obama's decision to cancel the missile-defense sites in the Czech Republic and Poland? It relied on new estimates of Iran's ability to build ballistic missiles. With today's news, it makes you wonder how reliable these estimates really are — and whether missile defense, given Iran's capacity to surprise, deserves a second look.

      Iran as a state has a right to its own peaceful nuclear program. This is our clear position. That is what I said to Barack Obama yesterday.

      I do not believe sanctions are the best way to achieve results. Sanctions were used on a number of occasions against Iran but we have doubts about the results. Nevertheless when all instruments have been used and failed, one can use international legal sanctions. That is common…I think we should continue to promote positive incentives for Iran and at the same time push it to make all its programs transparent and open. Should we fail in that case, we'll consider other options.
      Sure... Putin's puppet wants to work up to meaningless sanctions.

That revelation came in a 5,000-word press release by Ali-Akbar Salehi, the new director of the Islamic Republic's Nuclear Project. (He was appointed last month after Ahmadinejad sacked the veteran director, Ghulam-Reza Aqazadeh, for supporting Mir-Hussein Mussavi in last June's presidential election.) Salehi stated that the Islamic Republic has acquired "a new generation of advanced and highly efficient centrifuges." He did not say where these centrifuges are located, how many are there, and when were they installed. Nor did he say why Iran is using its old and inefficient centrifuges in Natanz instead of the "new and advanced" ones he has mentioned. The only logical explanation is that they are being used in a secret and parallel program — and that means Iran may already have enriched enough uranium to make a few bombs.

      Today, Obama spoke for a growing cadre of powerful nations — France, Britain, Germany and for the first time perhaps even Russia — in condemning Iran. Amid intelligence that Iran has kept a second nuclear facility, capable of producing 3,000 centrifuges, hidden from weapons inspectors for years, Obama warned that unless Iran acts immediately, punishment will be swift. "Iran is breaking rules that all nations must follow," he said.

      There is legislation in the House and Senate that has strong bipartisan support; it would impose “crippling sanctions” on the Islamist regime. Pass those bills. Impose those sanctions.       Obama announced that he is sending a senior US official to meet with the Iranians on October 1. And with that announcement, any residual doubt that Obama is willing to live in a world in which Iran is armed with nuclear weaponry dissipated completely.

      In the meantime, in his address to the UN General Assembly on Wednesday and in his remarks at his meeting with Netanyahu and Abbas on Tuesday, Obama made clear that, in the words of former US ambassador to the UN John Bolton, he has "put Israel on the chopping block." He referred to Israeli communities located beyond the 1949 armistice lines as "illegitimate."

      Moreover, Obama explained that Israel can no longer expect US support for its security if it doesn't bow to his demand that it surrender all of the land it has controlled since 1967.

      Apparently it is immaterial to the US leader that if Israel fulfilled his demand, the Jewish state would render itself defenseless against enemy attack and so embolden its neighbors to invade. That is, it matters not to Obama that were Israel to fulfill his demand, the prospect of an Arab war against Israel would rise steeply. The fact that Obama made these deeply antagonistic statements about Israel at the UN in itself exposes his hostility toward the country. The UN's institutional hostility toward Israel is surpassed only by that of the Arab League and the Organization of the Islamic Conference.

      So given Obama's positions toward Israel on the one hand and Iran and its allies on the other, it seems clear enough that the logical endpoint of Obama's policies would look something like Brzezinski's recommended course of action. Moreover, Obama's foreign policy as a whole makes it fairly easy to imagine him ordering the US military to open hostilities against a US ally to defend a US adversary - even as that adversary goes out of its way to humiliate Obama personally and the US in general.

      Since Obama took office, he has been abandoning one US ally after another while seeking to curry favor with one US adversary after another. At every turn, America's allies - from Israel to Honduras, to Columbia, South Korea and Japan, to Poland and the Czech Republic - have reacted with disbelief and horror to his treachery. And at every turn, America's adversaries - from Iran to Venezuela to North Korea and Russia - have responded with derision and contempt to his seemingly obsessive attempts to appease them.

He highlighted legislative language that would open the door to taxpayer-funded abortions. He pointed out that when amendments were introduced this summer that would have protected against this — would have protected life — they were shot down. That’s a bad precedent. If that’s how life fares when the C-SPAN cameras are on, what happens when it comes time for the behind-closed-doors compromises?

      Not only is Rigali the ordinary of Philadelphia, he engages in the health-care debate in his position as chairman of the Pro-Life Activities Committee of the U.S. Bishops Conference, speaking on behalf of all the bishops of the Catholic Church in the United States. And he is far from the only bishop who has spoken out against some of the doing-harm details that have turned up in some versions of the health-care legislation. Denver’s Archbishop Charles J. Chaput put it bluntly: “Killing or funding the killing of unborn children has nothing to do with promoting human health, and including these things in any ‘health care’ proposal, no matter how shrewdly hidden, would simply be a form of lying.”

The bishops in whose dioceses these hospitals reside represent the largest health-care provider in America, one that has been vital to the American story. And they are, by the way, on board with the idea of reforming health care, ensuring that everyone who needs care gets care (it being their business and all).       First, there are already plenty of studies showing that malpractice abuse comprises anywhere between 2% and 10% of all medical costs today. For a $2 trillion a year industry, even the low end would mean $40 billion a year in cost savings, and $400 billion over the ten-year period that Obama uses as his scale. That’s five times what Obama got the pharmaceuticals to concede in order to bring ObamaCare’s costs down, in comparison. The question here should be why the pharmaceuticals had to knuckle under to the White House while the trial lawyers get off scot-free.

      As Kimberly Strassel notes in the Wall Street Journal today, the answer is — because Congress wants to make it even easier for lawyers to exploit malpractice claims, and in new and dangerous ways...

      During the markup of a bill in the Senate Health Committee, Republicans offered 11 tort amendments that varied in degree from mere pilot projects to measures to ensure more rural obstetricians. On a party line vote, Democrats killed every one. Rhode Island senator and lawyer Sheldon Whitehouse went so far as to speechify on the virtues of his tort friends. He did not, of course, mention the nearly $900,000 they have given him since 2005, including campaign contributions from national tort powerhouses like Baron & Budd and Motley Rice.

      Even Senate Finance Chair Max Baucus, of bipartisan bent, has bowed to legal powers. The past two years, Mr. Baucus has teamed up with Wyoming Republican Mike Enzi to offer legislation for modest health-care tort reform in states. That Enzi-Baucus proposal had been part of the bipartisan health-care talks. When Mr. Baucus released his draft health legislation this weekend, he’d stripped out his own legal reforms. The Montanan is already in the doghouse with party liberals, and decided not to further irk leadership’s Dick Durbin ($3.6 million in lawyer contributions), the Senate’s patron saint of the trial bar.

      Over in the House the discussion isn’t about tort reform, but about tort opportunities. During the House Ways & Means markup of a health bill, Texas Democrat Lloyd Doggett ($1.5 million from lawyers) introduced language to allow freelance lawyers to sue any outfit (say, McDonald’s) that might contribute to Medicare costs. Only after Blue Dogs freaked out did the idea get dropped, though the trial bar has standing orders that Democrats make another run at it in any House-Senate conference.

      It says everything that Mr. Obama wouldn’t plump for reform as part of legislation. The president knows the Senate would never have passed it in any event. Yet even proposing it was too much for the White House’s legal lobby. Mr. Obama is instead directing his secretary of health and human services to move forward on test projects. That would be Kathleen Sebelius, who spent eight years as the head of the Kansas Trial Lawyers Association.

      How likely will a positive report come from tort-reform pilot projects run by the former executive director of a state TLA? About as likely as getting Democrats to vote to impose them even if they do succeed. It’s not just because the trial lawyers provides tons of cash to Democrats, although that’s certainly true. Trial lawyers afflict the very entities that the liberal wing of the Democratic Party likes to demonize — the rich, corporations, the rich, doctors (remember Tonsil Vultures and Foot Rustlers?), the rich, etc. It’s an ideological as well as financial marriage.

      Obama’s not involved in writing the legislation anyway. He’s made himself irrelevant enough that he can toss in a couple of lines about the subject without having it change the situation one iota. But even if was involved in it, Obama has been pretty clear about his opposition to tort reform — as he was just three months ago when he spoke to the AMA...

      HCAN has a $40 million budget, with $10 million pitched in by Atlantic Philanthropies – a Bermuda-based organization fronted by Soros acolyte Gara LaMarche. Also in the money mix: Notorious Democrat donors Herb and Marion Sandler, the left-wing moguls who made billions selling shady subprime mortgages and helped Soros fund his vast network of left-wing activist satellites. By their side is billionaire Peter Lewis of Progressive Insurance, whose “Progressive Future” youth group has dispatched clueless volunteers armed with clipboards and literature bashing Rush Limbaugh and Fox News to scare up support for Obamcare.

      ACORN and HCAN are linked by left-wing philanthropist Drummond Pike, who heads the non-profit Tides Foundation/Tides Center. As the tax disclaimer for HCAN discloses, “HCAN is related to Health Care for America Education Fund, a project of The Tides Center, a section 501(c)(3) public charity.” For decades, the Tides Center and its parent organization, the Tides Foundation, have seeded some of the country’s most radical activist groups of the Left, including the communist-friendly United for Peace and Justice, the jihadist-friendly National Lawyers Guild; and the grievance-mongering Council for American-Islamic Relations.

      Pike is the same philanthropist who assisted ACORN founder Wade Rathke after his brother, Dale, was caught embezzling nearly $1 million from the community organizing group. Rathke sits on the Tides Foundation board of directors. In a conspiracy to cover up Dale Rathke’s massive theft of funds, Pike volunteered to buy a promissory note worth $800,000 to cover the debt. These are the populist do-gooders supposedly looking out for you and your health.

      Why do they want Obamacare? An internal ACORN memo I obtained from August 2008 makes the motives clear. “Over our 38 years, health care organizing has never been a major focus either nationally or locally for ACORN,” wrote ACORN Philadelphia region director Craig Robbins. “But increasingly, ACORN offices around the country are doing work on health care.” The goal: “Building ACORN Power.”

      Yuval Levin : Those Pesky Details

      HHS Secretary Kathleen Sebelius takes to the op-ed page of the Washington Post this morning to make the case for the Democrats’ health-care reform. The case she makes helps highlight why that effort is in such trouble. This bit is certainly the most fun:

      President Obama and I are working closely with Democrats and Republicans in the House and Senate and health-care experts to make sure we get the details of health reform right. But we can't let the details distract us from the huge benefits that reform will bring.

      Can’t let those “details,” like what the plan will actually consist of and what it will cost, distract us from the huge benefits. The striking thing about her case as a whole is actually the utter lack of details. It’s clear the phrase “health reform” has tested well, as she asserts that this vague concept will perform all manner of impressive feats. “Through health reform, we can give every American access to quality, affordable health insurance so that if they do get sick, they have the best chance possible of getting better without bankrupting their families,” she writes. “Reform will close the gaps in our current system.” “Health reform means unleashing America's entrepreneurs to chase their big ideas.”

      But what is “health reform”? What specifically does the administration support or oppose? How in particular will any of this happen? Those are just distracting details, apparently.

      We all experience life-changing moments at odd times.   Those chance encounters that you remember for the rest of your days because what you learned was such a shock to your insulated lifestyle.

      One of those moments for me came several years ago when my company was asked to feed Thanksgiving dinner to a group of 100 local, homeless, school children.  I agreed to the request and showed up at the appropriate time with several roast turkeys, mashed potatoes, gravy and other "holiday fare".  

      The kids were late!   It was during my busy season so I wasn't real happy about that.  I was a little ashamed of my personal reaction when I discoved that the reason they were late was that they were having to hunt down the children.  "What do you mean?", I asked.  And was told that the kids "couch surf" between different homes each day, so it takes a little extra time to find them.   But eventually they arrived and proceeded to eat. 

      At the end of the meal, a six year old boy came back to the buffet and asked if he could take home some dinner to his mother.  He said, "I don't want my Mom to go hungry tonight".   And my universe was upended.   The realization finally hit home that I lived in the richest country in the world....and there were still 1st graders who felt obligated to try to feed their family.   They weren't worried about things I think of kids worrying about.  Things like missing TV or tomorrow's recess or their next soccer game.  They were worried about feeding Mom at the ripe old age of 6!  THAT'S SO WRONG!!!

      I've done that same event every year since.  It's one that I never hand off to an employee because I never want to be so comfortable that I  forget that boy's situation.  (And I will remember the look in his eyes until the day I die.)

      Hunger is a major problem both for this country and for Missouri:

      "one in five Missouri children lives with hunger. That ties us with Louisiana for the nation's seventh-highest rate, according to a report released last month by the hunger-relief charity Feeding America.

      Or that the recession has pushed the number of poor Missouri kids who qualify for free or reduced-price school lunches by 8.3 percent this year, well above the national average."

      I tell you this story to introduce you to this woman:

      Dressed in her cute pink outfit, surrounded by her husband and children is Missouri State Legislator Cynthia Davis from St. Charles County. She is the co-owner of BACK TO BASICS CHRISTIAN BOOKSTORE in O'Fallon Missouri.  "Rep. Davis has been appointed to serve as the Majority Floor Whip. She was also elected by her peers to be the Secretary for the Women Legislators of Missouri and was also elected to be the Vice-President of First Capitol Federation of Republican Women. She is also serving as the Republican Committeewoman for the Dardenne Township."  She also chairs the Missouri House Special Standing Committee on Children and Families.  

      She recently released a statement in her newsletter on a summer program sponsored by the Agricultural Department to feed school aged children during the summer.   This program last year fed 3.7 million meals at a total cost of under 9.5 million dollars.  (By using local churches and food pantries, that keeps the costs to under $3/meal.  Pretty efficient use of our tax dollars if you ask me.)


      The chair of the Committee on Children & Families wrote:

      "While I have not seen this as a problem in my district, it is entirely possible that the (summer feeding) program is designed to address problems that exist in other parts of Missouri," Ms. Davis says in her newsletter.

      "The right way to solve this is with more education. If parents ... don't know how to serve nutritious meals, let's help them learn to do that."

      Why have meals at home with your loved ones if you can go to the government soup kitchen and get one for free? This could have the effect of breaking apart more families.

      Anyone under 18 can be eligible? Can’t they get a job during the summer by the time they are 16? Hunger can be a positive motivator. What is wrong with the idea of getting a job so you can get better meals?

      Tip: If you work for McDonald’s, they will feed you for free during your break.

      Families may economize by choosing to not waste hard earned dollars on potato chips, ice cream, or Twinkies. Perhaps some families will buy more beans and chicken and less sweets.

      They are using a "crisis" to create an expansion of a government program. Parents naturally love their children and enjoy caring for their children just as much as ever during an economic downturn...Laid off parents could adapt by preparing more home cooked meals rather than going out to eat.


      Rather obviously, Rep. Davis is a little out of touch with the real world that many of her fellow Missourians face.

      Here's a reality check for you:

      This is what a food line looks like.   There are lots of them in Missouri.   This one's from Southwest Missouri!  Does this look like a made-up "crisis" just to increase government?

      Rep. Davis is a disgrace to her office and to our state!  She should be ashamed of herself and her district should be ashamed of themselves if they re-elect her.

      1)  Make a donation of food or money to a local food pantry.   Make sure the donation is made in honor of Rep. Davis!

      2)  You can e-mail Rep. Davis yourself at cynthia.davis@house.mo.gov

      3)  Contact your local state legislator to ask them to lobby Republicans to remove Rep. Davis from her chairmanship of the Committe on Children and Families.   Missouri deserves better representation than this!

      (Poplar Bluff, MO)-- A 15-year-old Poplar Bluff boy has been hospitalized after he was doused with gasoline and set on fire, according to police.

      A 16-year-old boy is accused of squirting gasoline on Walter Currie Jr. and lighting the fire. The boy is being charged as a juvenile with first-degree assault and is being held in the Butler Ripley County Juvenile Authority and Detention Center.

      Poplar Bluff police said the victim was standing with some friends Saturday when two boys with whom Walter was feuding came up to him. One of the two boys squirted Walter with a squeeze bottle filled with gasoline, then ignited it with a lighter.

      Walter is in good condition at a St. Louis-area hospital with burns to his chest, stomach and arms.

      Poplar Bluff Deputy Police Chief Jeff Rolland said the incident happened about 9 p.m. Saturday near Main  and Davis streets.

      Rolland said there was a confrontation between the two youths that continued from an earlier incident.

      "This confrontation led the suspect juvenile to douse the victim juvenile with a bottle of gasoline and then light the gasoline, which caused the victim to be burned to his abdomen, chest and his neck area," Rolland said.

      Rolland said that the motive is being investigated but that it stems from confrontations between the two youths and their friends June 10 and earlier in the year at school.

      Walter Currie Sr., 56, the victim's father, says he believes that the attack on his son was racially motivated and that he is worried the attacker will never be brought to justice. His son is black; the attacker is white.

      Rolland doesn't believe the incident involved race.

      "At this time, we don't have anything that indicates that it was racially motivated," he said. 'It just appears that these two young men did not like one another. Now, what that reason is is a good question, and we would like to get the answer to that."

      Rolland said police are investigating why the suspect, who was arrested at the scene, had the bottle of gasoline. Rolland said the attack is the first of its kind.

      "It's makes you want to scratch your head," he said.

       

      Walter is a freshman at Poplar Bluff High School. His father said he was standing outside a Poplar Bluff store with his cousin, also 15, when he was attacked.

      "The only thing I know is what Junior told me. (He said) he heard that somebody was going to jump him," Currie said. "He saw the guy, who was talking. So, he went over and asked the guy, and the next thing he knew the guy poured the gas on him and lit him up."

      Currie, 56, said his nephew tried to help put the fire out and then tried to get to the suspect. The boy was rushed inside the store for protection, he said.

      Currie said he was shocked. when he learned of the incident. He said the assault was premeditated.

      "I can't understand why he would walk around carrying gas in a (squirt) bottle," he said.

      Currie said he did not know the teen who attacked his son, but he believed that one of his two sons had attended school with him. The father said his family is upset over the attack.

      "We don't get no justice down here in this town," he said.

      The leak clearly shows that some in the CIA have resolved not to take the heat for waterboarding all by themselves, and shows what a miscalculation Obama made by releasing the legal memos. Until that time, the CIA appeared content to let people talk about Bush-era tactics in academic terms, especially since the agency had dropped the procedures in question several years earlier. After the release of the OLC memos prompted talk of prosecutions, that all changed, and now Obama knows how Bush felt when the CIA decided to leak damaging information to the press.

      We can expect this topic to die a quiet death in the next few days. Obama already hit reverse after his selective release when it became apparent that he’d opened Pandora’s Box and exposed Democratic leadership to the issue.

      I have an article (posted on the homepage this afternoon) which recounts how the Obama administration is urging the Sixth Circuit U.S. Court of Appeals to adopt the same interpretation of federal torture law that it is investigating former Bush administration lawyers for developing. (And why shouldn't AG Eric Holder rely on the memo written by Jay Bybee and John Yoo in 2002? After all, the Third Circuit Court of Appeals already adopted it as the law of the United States in a ruling last year — as I also recount in the article).

      Andrew C. McCarthy on 'The Justice Department’s Torture Hypocrisy' : Investigate Bush lawyers’ torture analysis one day, cite it favorably the next.

      The Obama Justice Department is engaged in the worst type of hypocrisy. Its Office of Professional Responsibility (OPR) is nearing completion of a 220-page report which will recommend that Attorney General Eric Holder refer former Bush administration lawyers to their state bar disciplinary committees over purported ethical lapses in the legal analysis those lawyers drafted to justify harsh interrogation techniques that critics — including President Obama himself — have labeled “torture.” The draft report, which is not public, was nevertheless reported on last night by the Washington Post and New York Times — apparently based on leaks from the Justice Department (in an ethics case, no less). Such bar referrals could result in profound professional and financial damage, potentially including disbarment — all due to actions the lawyers took in defense of the United States after the 9/11 attacks.

      Yet, even as the OPR report is being finalized, even after Obama declared himself open to the possibility of criminal prosecution against the Bush officials, and even after Holder promised to conduct an investigation that would “follow the evidence wherever it takes us, follow the law wherever that takes us” (emphasis added), the Obama Justice Department is relying on the very same legal analysis in order to urge a federal appeals court to reject torture claims. In fact, as the Obama Justice Department argued to that appeals court a little over a week ago, the torture law analysis in question has already been adopted by another federal appeals court.

      This Third Circuit legal theory is the exact same legal theory the Obama administration has urged the federal court to adopt in Demjanjuk, where it is fending off torture allegations. It is, simultaneously, the exact same legal theory developed by Bybee and Yoo — the legal theory that forms the basis for the Obama administration’s signaled determination to condemn morally, and potentially to prosecute criminally, its political adversaries.

      Given that the Bush DOJ memos in question evince an assiduous effort not to cross the line into torture — i.e., they demonstrate the very opposite of the evil motive to inflict torture that the Obama DOJ has just told a top federal court is necessary to establish a violation — it is simply shameful for the Justice Department to be pursuing this partisan witch-hunt.

      An intelligence report sent recently to Capitol Hill shows that members of Congress were briefed 40 times since 2002 on aspects of the so-called "enhanced interrogation" program. Many have decried the techniques used in the program as torture.

      The list seems to undercut the claim by House Speaker Nancy Pelosi (D-Calif.), then-minority leader and ranking member on the House intelligence committee, that she was never told at a 2002 briefing that waterboarding and other aggressive techniques had been used or would be used...

      "seems to undercut"? Or simply exposes her as a sociopathic liar?

      ... the mainstream media portraying this as Republicans desperately seizing on an issue as a way to embarrass the Obama administration. Well, that's what an opposition does. And it isn't as if terrorists running around in America is not a serious issue.

      But I think what is really interesting about it, and the reason it is going to get traction, is because it symbolizes the degree to which Democrats were hypocritical and irresponsible in attacking the Bush administration and all the measures it took in keeping us safe in the war on terror.

      For example, the wiretapping, which it attacked as a trashing of the constitution, is now being continued. We have the rendition policy, an attack on human rights, is also being continued. The military commissions, which Obama himself had said had been a failure, all of a sudden the Obama administration is resurrecting it.

      And Guantanamo is the biggest symbol of them all.

      Obama's idea is we are safer if the world likes us, and that's why you have to close at Guantanamo and do all these other nice things. Now we're going to see whether the closing of Guantanamo is going to reduce the recruiting of terrorists, is going to make our allies help us in Afghanistan and elsewhere, and will make us more safe.

      What we are seeing is yet another chicken, albeit a large one, coming home to roost — especially when we were lectured throughout 2007-8 that what has now become the current Obama anti-terror protocols (e.g., rendition, wiretaps, email intercepts, Predator drone executions, staying the course in Iraq, etc) were once all proof of Bush's trampling of the Constitution that had only empowered our enemies.

      At some point, someone in the Obama media is going to have to come to their senses and admit, "Okay, enough is enough, this is getting shameless beyond belief."

      Scooter Libby went to prison for the "outing" of a desk-jockey CIA agent. He forgot conversations. Pelosi forgets briefings. And the outing of our entire intelligence apparatus by Democrats is OK.

      Remember the thrilling days of yesteryear and the alleged outing of the already known CIA officer Valerie Plame? We were told then that the Vanity Fair cover girl's 15 minutes of fame jeopardized our national security even if everybody already knew who she was.

      "Scooter" Libby went to prison because his memory of events and who said what to whom regarding Plame differed from the recollections of others, particularly news reporters. Alleged contradictory statements were portrayed as a deliberate and malicious obstruction of justice. So what about Pelosi?

      Here we have the release of memos describing in detail how we have interrogated terrorists in the past, an action that gives aid and comfort to the enemy, revealing means, methods and sources, while jeopardizing real security officials. How does that not jeopardize America's national security?

      When Libby's sentence was justifiably commuted by President Bush, Pelosi was outraged.

      So here we have the Speaker of the House, Nancy Pelosi, offering up contradictory statements to the press and exhibiting a faulty memory that disagrees with the recollections of others regarding briefings concerning waterboarding.

      The presidency of George W. Bush began to unravel when some in high positions at the Central Intelligence Agency began waging a covert campaign against him.

      It began in the summer of 2003 when officials at the CIA asked the Justice department to open a criminal investigation into who had disclosed to columnist Robert Novak that Valerie Plame, wife of controversial former diplomat Joseph Wilson, worked at the CIA.

      The officials knew at the time the Intelligence Identities Protection Act did not apply to Ms. Plame, who'd been out of the field for more than five years.

      Another blow was struck with the publication in 2004 of the book "Imperial Hubris" by Michael Scheuer, who'd headed the bin Laden desk during the Clinton administration. It was harshly critical of the Bush administration's conduct of the war on terror in general, and the invasion of Iraq in particular.

      Never before had a serving officer been allowed to publish such a book.

      Why would some at the CIA want to sabotage President Bush? One motive might have been to deflect blame for intelligence failures. The CIA confidently had predicted Saddam Hussein possessed weapons of mass destruction. But none were found. The tactical intelligence the CIA provided to the U.S. military forces invading Iraq proved nearly worthless. And the CIA was caught flat-footed by the insurgency that developed several months after Saddam's fall.

      There may have been a simpler motive. The novelist Charles McCarry was a deep cover CIA operative for ten years. "I never met a stupid person in the agency," he said in a 2004 interview. "Or an assassin. Or a Republican."

      It is enough for the public now to know that Pelosi and others were briefed and that no meaningful objections and steps to halt the CIA (e.g. cutting off funding) were ever raised.

But more importantly it reminds the voters that until it became politically expedient there was bipartisan consensus for enhanced interrogation techniques.       Ha ha ha! CIA / CYA! What a riot! But when the uncontrollable guffaws die down, here's what I'd like to know from Senator Bond.

      Some of us argued that Eric Holder was not suitable for Attorney General. Among the lengthy list of problems we cited, again and again, was that he had promised a "reckoning" for Bush administration officials who had been involved in interrogations and other post-9/11 national security policies that have kept this country safe from additional attacks.

      Don't be ridiculous, scoffed our Republican sages. For you see, unlike the rest of us, they'd gotten to spend quality time with Eric — an experienced, mature law-enforcement pro who would never, ever let political considerations enter into his decision making — and he had made a solid commitment that he absolutely would not sic the Justice Department on former Bush administration officials. Why, Sen. Bond assured the Washington Times, there was no reason not to support Holder's confirmation — regardless of the objections raised by us knuckle-dragging, right-wing loons — because Holder had solemnly promised Bond in a private meeting that there would be no prosecutions of Bush officials.

      I don't think I was the only one who observed that Holder had made no such commitment...
      Matthew Vadum : Soros Show Trials
      The so-called Commission on Accountability which mysteriously appeared on the political scene a few days ago to push for show trials related to War on Terror interrogation policies is a PR hoax created by liberal philanthropist George Soros and political operatives sympathetic to the Obama administration.

      The push is part of a vindictive campaign to pay back the architects of the War on Terror for making a good faith effort to defend America

      To some the arrival of the Commission on Accountability, with its 19 member groups including Amnesty International USA and Human Rights Watch, suggested a significant groundswell of support in the nonprofit activist community for the proposed creation of an independent, non-partisan commission to examine the treatment of captured suspected terrorists. These groups all want Bush administration officials investigated for doing their jobs.

      ...at least eight of the 19 left-leaning institutional members of the Commission on Accountability are funded by the secretive Soros.

      The Center for Constitutional Rights, an anti-American public interest law firm whose website praises the Viet Cong, is headed by Che Guevara apologist Michael Ratner. The Center has filed numerous lawsuits aimed at hobbling the War on Terror and is a frequent defender of Lynne Stewart, a lawyer convicted of aiding Islamist terrorists.

      To groups like the Center for Constitutional Rights, the show trial is an essential bit of political theater. The storyline is usually easy to follow. A bad guy is identified as an enemy of the public and charged with a crime against the people. All the evidence shows this and often without much ado a conviction is secured. Unlike a real trial with strict procedures, rules of evidence, and real defense counsel, a show trial is highly efficient much like authoritarianism is supposed to be.

      The Center's Ratner already had a trial run. A make-believe kangaroo court composed of far-left extremists already convicted the Bush administration. It was called the "International Commission of Inquiry on Crimes Against Humanity Committed by the Bush Administration."

      Ratner's witch trial could serve as a rough blueprint for a real commission.

      The United Socialist States of America and the "Last" Postmodern Man

       
       
      There are two articles that firmly encapsulate in my mind the direction our nation is moving in and I found myself deeply troubled.  I am troubled at a level that is visceral and almost makes me ill because I fear that the problems of the moment, as bad as they undeniably are, will usher in not a better world, but a worse one. 

      The first article is from Newsweek.  The headline proclaims it all- "We Are All Socialists Now."  Rather than explain the full piece let me leave a quote from the piece that sums it well:

      "A decade ago U.S. government spending was 34.3 percent of GDP, compared with 48.2 percent in the euro zone—a roughly 14-point gap, according to the Organization for Economic Cooperation and Development. In 2010 U.S. spending is expected to be 39.9 percent of GDP, compared with 47.1 percent in the euro zone—a gap of less than 8 points. As entitlement spending rises over the next decade, we will become even more French...

      Now comes the reckoning. The answer may indeed be more government. In the short run, since neither consumers nor business is likely to do it, the government will have to stimulate the economy. And in the long run, an aging population and global warming and higher energy costs will demand more government taxing and spending. The catch is that more government intrusion in the economy will almost surely limit growth (as it has in Europe, where a big welfare state has caused chronic high unemployment). Growth has always been America's birthright and saving grace."

      The second article comes from an author that I have always been deeply fond of, the Classical military historian, Victor Davis Hanson.  As I read his concluding paragraphs and thought about them in conjunction with the Newsweek story my fears of the past came back to me.  Hanson makes explicit how the post-modern, secularized man that refuses to reproduce and looks only for the pleasures of this world has led to statism.  Below is the relevant section.

      "I had a conversation (an argument) recently with a European, about contemporary culture. I tried to explain the mutually reinforcing elements of socialism, atheism, utopianism, pacifism, and statism (he was giving America a second chance to morph into Euros under Obama). But if one believes in no transcendence, that there is nothing other than the present, then for too many satisfying the appetites becomes the prime directive. Childlessness, living at home in one's 30s, dependence on the state, all that derives from a system that ensures equality of result, and substitutes Logos and Ratio for any notion of a deity that sees sin and sacrifice, and reminds us that our souls are immortal and affected by their brief residences in our flesh. In other words, that Euros expect free health care, free care for their elderly parents, free schools, free defense from the USA, harbor little hopes for rising above the station of anyone else, find housing and jobs scarce, and don't feel they can or want to leave behind something for their children larger than what they inherited-- are all interrelated phenomena. European postmodern man offers mostly platitudes that he thinks please those who might be dangerous to him, and finds psychological recompense and solace by gratuitously trashing those who aren't. Note how such constitution peoples favor Hamas over Israel--and usually almost anyone over the US. Were Hamas a successful democracy that took no European aid and offered it in turn no threats, and Israel a failed fascistic terrorist movement that depended on Europe for aid and comfort, while engaging in terrorism and voicing postmodern platitudes about oppression, then we would expect Israel to be a strong European ally. (I think many Europeans are more sympathetic to the Palestinian Authority or Syria or Iran than the incipient democracy in Iraq)."

      So how is "post-modern" man different from Nietzsche's terrible vision of the "Last Man."  Compare for yourself as Nietzsche's prophet, Zarathustra speaks:

      "I say unto you: one must still have chaos in oneself to be able to give birth to a dancing star. I say unto you: you still have chaos in yourselves.

      Alas, the time is coming when man will no longer give birth to a star. Alas, the time of the most despicable man is coming, he that is no longer able to despise himself. Behold, I show you the last man.

      'What is love? What is creation? What is longing? What is a star?' thus asks the last man, and blinks.

      The earth has become small, and on it hops the last man, who makes everything small. His race is as ineradicable as the flea; the last man lives longest.

      'We have invented happiness, 'say the last men, and they blink. They have left the regions where it was hard to live, for one needs warmth. One still loves one's neighbor and rubs against him, for one needs warmth...

      One still works, for work is a form of entertainment. But one is careful lest the entertainment be too harrowing. One no longer becomes poor or rich: both require too much exertion. Who still wants to rule? Who obey? Both require too much exertion.

      No shepherd and one herd! Everybody wants the same, everybody is the same: whoever feels different goes voluntarily into a madhouse.

      'Formerly, all the world was mad,' say the most refined, and they blink...

      One has one's little pleasure for the day and one's little pleasure for the night: but one has a regard for health.

      'We have invented happiness', say the last men, and they blink."

      I see little difference.

      Nietzsche said that God is Dead, by which he meant that WE have killed him in our desire to be "enlightened" during our push to become masters of our own fate in this world without transcendance.  Nietzsche saw that without God, nihilism, a lack of faith in anything, was inevitable.  He tried to replace God with a Godlike man- the notorious Ubermensch or Overman.

      He may have been wrong in his solutions, but he clearly diagnosed the malady of modern man.  Today more than ever we stand on the precipice of America joining Europe and becoming "post-modern" which is really nothing more than becoming "Last Men."

      The greatness of spirit that was such a constant through most of human history is intentionally being homogeneized with the vague, but discernable desire to enforce equality of outcome.  "Greatness" is scoffed at, ridiculed, and referred to as "selfish", "narrow-minded", and contrary to the communitarian ideals that supposedly will save this planet from our own evil born of ignorance.

      There will not be a levelling up, there will only be a levelling down.  From where will come the next Plato, Aristotle, Alexander, Cicero, Augustine, Aquinas, or Dante?  Where will even be the next Washington, Lincoln, or Churchill?

      Socialism breeds sloth.  I know that there is a need for government to restrain the excesses that are inherent in flawed man.  However, we are taking steps that go far beyond the necessary restraints and limited assistance that is needed to assure people don't "fall through the cracks."  We are choosing to make the world that our children (if we choose to have them) are born into a world of bland mediocrity that denigrates what has been so noble about humanity.

      Yes, its true, the price for greatness and nobility is some instability, some danger, but the desire to eradicate that can only lead to a sterility that saps man of what has made him human. 

      The religious societies are vastly more human than the experiment we are attempting to consolidate.  Ironically, there is disorder in those societies, but they are human.  Perhaps, that is not as bad a thing as so often we think it is.  Perhaps, we'll look more deeply before setting sail for a destination that is preordained to destroy our very souls and leave us empty husks that will over time be easy pickings for those that still understand how to be humans.

      The Romans largely failed to do that and they became history.  America is not yet doomed for a repeat performance, but our Attila and Alaric is out there waiting for an opportune moment to strike at our cracked foundations.  We should defend those foundations and not become the "Last" Post-Modern Man.

      It is safe to say Obama's foreign policy has so far been an unmitigated disaster.
      He scolded the United States for being "arrogant, dismissive", and "derisive" toward Europe.

      During his European Celebrity Tour, he was greeted by adoring fans and leaders alike, only to be snubbed by our "Allies" regarding his proposal for more combat troops to Afghanistan and more money to help fight a global depression.

      Though Obama has a new "comrade" in Prime Minister Medvedev, the communist will do nothing to assist with the current North Korean nuclear stand off.

      The Chinese, as well, refuse to do anything to punish the North Koreans, even going so far as congratulating Kim Jong Ill on his victorious election (I believe he obtained 99.9% of the vote).

      Obama bowed to the Saudi King, and our oil prices have rose ever since.

      Spoke heatedly about how North Korea "broke the rules" after their much publicized and anticipated missile launch, relying on the UN Security Council to pass a resolution condemning the action. That action did not come until a full two weeks after the missile was launched. They have now resumed the operation of their nuclear facilities which are capable of producing weapons grade nuclear material.

      Dropped a key demand that Iran shut down its nuclear facilities prior to engaging in talks concerning its nuclear ambitions. It would also allow Iran to continue enriching uranium during any talks.

      Chastised us for our treatment of Native Americans centuries ago. Also scolded us for our past history of slavery.

      Pointed out that we have been the only nation to ever use a nuclear weapon, allowing for no context, of course.

      Has no coherent plan to deal with " pirates", or as some more appropriately call them, Islamic terrorists.

      At the start of the 5th Summit of the Americas, Obama gave a friendly "Yo, that's my dog" handshake to Hugo Chavez, American hating "leader" of Venezuela, and personal friend to Fidel Castro.

      He has lifted restrictions on Cuba, long an enemy of the United States, and purveyor of human rights atrocities.
      So, with all of these misguided and dovish overtures aimed to paint the United States as a world thug who, under Obama the Savior, needs to repent for it's eeeeevil ways, how does he see fit to treat our strongest, staunchest democratic ally in the middle east, Israel?
